In
a development that Chicago’s Mauck & Baker Law Firm attributes to a
recently-implemented parental notification law, Illinois’ abortion rate
among minors has dropped almost 28%.
The state Department of Public Health reported last week that over
500 fewer abortions among minors took place in 2014 than in 2013. The
Illinois Parental Notification Act of 1995 was originally passed more
than twenty years ago, but was blocked from implementation due to
ongoing legal challenge, and did not take effect until 2013.
Mauck & Baker got involved in 2012, joining Alliance Defending
Freedom in filing an amicus curiae brief with the Illinois Supreme Court
on behalf of Christian Medical & Dental Association, the American
Association of Pro-life Obstetricians and Gynecologists, and the
Catholic Medical Association. The court unanimously ruled in favor of
the law in July 2013.
“[M]inors are best served when they are fully informed and can
benefit from their parents’ wisdom and support,” attorney Richard Baker
said. “Each young girl is important. Parents are important. And each
unborn life is important. About 2000 years ago, unto us a child was born
the Messiah. We are honored to have a part in seeing 500 children born
in Illinois who may someday come to faith in Him.”
The data also shows that the state’s overall abortion rate dropped by
6% in 2014 to below 40,750 abortions, the lowest Illinois has seen
since Roe v. Wade was handed down in 1973.
Pro-choice author, Alesha E. Doan, wrote a book condemning
pro-lifers. But in the following quote, she acknowledges how prolifers’
use of pictures has “humanized” preborn children and changed the way the
public views abortion:
The entire pro-life movement has made substantial gains
in humanizing a fetus at every stage of pregnancy and helping to
establish personal rights for the unborn. Enlarged pictures of aborted
fetuses and other graphic illustrations are commonly displayed at
protests and may help contribute to a changing, more humanized,
conceptualization of a fetus and in turn help sway public approval
against the permissibility of using elective abortion services to
resolve unwanted pregnancies.

Woman asks Missouri Court of Appeals for custody of frozen embryos
By Dave Andrusko
Jalesia McQueen
As is always the case, the details are different but the legal
question remains the same: what happens to frozen embryos when a couple
splits and there is a fight over the embryos’ future.
Prior to their divorce in 2014, immigration lawyer Jalesia McQueen
and Justin Gadberry had two twin boys through in-vitro fertilization.
When the couple went to court in 2014 over what would happen to the
remaining two frozen embryos, a St. Louis County trial court judge ruled
that “Neither could use or destroy the embryos without the written
consent of the other,” according to the Associated Press.
In appealing the decision to the Missouri Court of Appeals last week,
Gadberry said she wants to use the embryos to have more children.
The AP noted that McQueen said in a news conference, “At the
time [the embryos were created] we signed an agreement about what to do
with the frozen embryos in the case of certain incidences.” She said
that she and her now ex-husband agreed that in the case of divorce, they
agreed she would get the embryos. However the trial court judge
invalidated the agreement. Jennifer Meckles reported that Tim Schlesinger, the attorney for Justin Gadberry, said
his client does not want to have
more children with his former wife, and said the pair had a “very
acrimonious” divorce. He said Gadberry would support a decision to
donate embryos to research or to an infertile couple, or even have them
destroyed. But he is not willing to allow McQueen to implant them in an
attempted pregnancy.
Several pro-life organizations are backing McQueen’s cause, including
Missouri Right to Life, Lawyers for Life, the American Association of
Pro-Life Obstetricians & Gynecologists, and the Thomas More Society.
The issue of frozen embryos and divorced couples is an ongoing battle
which has received national attention because of the high profile case
of has filed a similar request in Los Angeles in a dispute between
“Modern Family” star Sofia Vergara and Nicholas Loeb, her ex-boyfriend,
who wants custody of the frozen embryos they created before breaking up.
Last month NRL News Today reported on the decision rendered by San Francisco Superior Court Judge Anne-Christine Massullo
who ruled that Mimi C. Lee must adhere to an agreement she’d made with
her ex-husband to destroy five frozen embryos if the couple divorced.
In its brief on behalf of McQueen, the Thomas More Society made a variety of powerful legal arguments
why the Missouri Court of Appeals should “recognize that the frozen
embryos are unique human beings with their own rights and should not be
subject to a contract dispute.”
Janet Folger Porter
A long-time pro-life leader has decided to run for the Senate in the
state of Ohio to challenge what she calls “the establishment” which has
refused to pass the pro-life Heartbeat bill. Janet Folger Porter has
been fighting abortion for over thirty years. Her leadership helped pass
the first ban on the infamous partial birth abortion method. In that
procedure, the abortionist delivers the preborn child up to the
shoulders, he then pierces the child’s skull with a pair of medical
scissors and suctions out the brain tissue, enabling the collapse of the
baby’s head which kills the child. The procedure was defended by Hillary Clinton during her term as a US Senator.
It was this now illegal abortion procedure that appeared to be described by
a high ranking staffer at Planned Parenthood caught on under cover
video by the Center for Medical Progress who exposed their grisly baby
harvesting operation. As a result, pro-lifers have called for an
investigation into the potential that Planned Parenthood is violating
the law.
Janet has a history of boldly speaking out and defending preborn
children in the womb. But, her advocacy has not been an easy one. Over
the years, Janet has made a number of enemies. In response to the
criticism, Janet said that she is not deterred by those who oppose her,
telling Live Action News that, “When you spend your life standing for God’s word and His principles people don’t always say nice things about you.”
Tragically, words are not the only “ammunition” that have been used
by Janet’s enemies over the years. The pro-life leader has also received
numerous threats, including someone who sabotaged her vehicle. It
happened in 1994 when abortion was front and center in the news much
like it is today.
Janet recalled seeing smoke coming out of her car prior to a
political rally for a pro-life Democrat candidate she had planned to
attend. After getting out of the car she saw a line of fire from the
driveway into her garage, but thankfully the fire was confined to her
car engine and she was not hurt. The fire was ruled as intentionally set
after someone cut her gas line and although no one was ever charged,
Janet had her suspicions that she was targeted because of her pro-life
activism.
“The arson investigator said the attack
was deliberate. The banner headline of the Cleveland Plain Dealer on
Friday, May 13, 1994, read: Right to Life Leader’s car Sabotaged, Odds are it is connected to abortion issue, police say.” The sticker on the bumper read: “Abortion? Pick on someone your own size.”
Janet wrote about the incident in her book, True to Life where she published this image of her burnt out car.
Janet’s thirty years of pro-life activism began in high school where
she was first convicted about abortion after she was shown a picture of
an aborted baby for the first time. Today, Janet has spent the last few
years working to pass the Heartbeat Bill in Ohio. This legislation works
on the premise that if death is decided when a heartbeat ends, then
life should be protected when the heartbeat begins. She told Live Action
News that her involvement in a failed pro-life initiative in South
Dakota helped birth the concept behind the Heartbeat Bill.
“The Supreme Court has said states can
intervene and protect life in the womb if there is a likelihood of
survival to live birth. But right now they are picking viability as
their marker. Well, we have a better one. It’s called the heartbeat,”
she said adding that, “Heartbeat is an indicator of life that is
universally recognized across the wold, why should we ignore it when it
comes to the very young?” she asked.

Janet said she is committed to protecting every preborn child in the womb, but for now, “If
we can’t rescue all the children out of the burning building all at
once, you carry out as many as you can – then go back for the rest,” she explained.
It was her passion to pass the Heartbeat Bill in the Ohio legislature
that promoted her decision to run for state Senate. Janet said that she
is hoping to unseat incumbent state Republican Senator Larry Obhof and
that she is running against what she calls “the Republican
establishment.” According to Janet the so-called “establishment” has
“blocked the most pro-life bill to ever pass the Ohio House of
Representatives, the Heartbeat Bill” which Janet calls, “our best chance
to save the most lives.” “They will tell you how pro-life they are. In fact, my opponent
will claim to have a 100%n voting record. Well that is easy to do when
you never vote on the most pro-life bill, the Heartbeat Bill which has
the most chance to save lives,” she stated.
Janet has accused her opponent, Larry Obhof, with refusing to
initiate and sign a discharge petition to bring the pro-life Heartbeat
Bill to the floor for a vote. “He claimed to a local news outlet that I never asked him to sign it,” Porter said. Porter holds certified receipt of letter she delivered to her opponent
“So I delivered the proof: the receipt
of the certified letter which I sent to him on October 21st along with
the return postcard which showed that he, in fact, received it.”
Janet’s determination has brought her before Ohio lawmakers many
times with several victories along the way. Janet has had plenty of
experience with lawmakers. After she co-founded Students for Life in
1985 at Cleveland State University as an undergrad student she became
Legislative Director of Ohio Right to Life for nearly a decade. It was
in this role that Janet helped pass pro-life laws including the Woman’s
Right to Know law (with a 24 hour waiting period), Parental Consent,
Fetal Homicide, protection against dehydration and starvation, as well
as the nation’s first ban on Partial Birth Abortion.
Janet explained to Live Action News that after asking others to run
against what she calls the “obstructionist Republican establishment” she
stepped up when no one responded. “If nobody else would do it, I put my own faith to action and I pulled petitions to run for the state Senate.” But, the feisty pro-life female leader said she has also launched her political campaign for the cause of liberty, “The
more I think about it, we could have a lot of fun in the Ohio Senate.
Instead of being on the outside begging them for their vote, we could
actually take our government back! Because, you know what? It doesn’t
belong to the establishment incumbents – it belongs to we the people.”
Janet said that her campaign needs
a lot of prayer, support, feet on the ground and, of course plenty of
contributions. Early voting in the state begins in a few months and the
election will take place March 15, 2016. But, despite the uphill battle,
Janet remained optimistic about her chances of winning:
“Here’s my chances with God all things are possible.”
The
Thomas More Society has filed an amicus brief on behalf of Nick Loeb,
the former fiancé of Modern Family star Sofía Vergara, in the dispute
over two embryos which were meant to be carried by a surrogate before
the couple split in 2014. The Daily Mail reports...
Thomas More
Society – a Chicago-based law firm which defends Christian causes with a
focus on those involved in the pro-life movement – filed an amicus
brief, which is also known as a friend of the court brief, in Los
Angeles.
The law firm
did so to aid Nick on his quest to gain control of the embryos and on
the behalf of the American Association of Pro-Life Obstetricians and
Gynecologists and the National Catholic Bioethics Center.
Loeb refers to the two female embryos as his “daughters” and is
fighting for their custody, while Vergara wants them destroyed. The
brief filed by the Thomas More Society states that the children created
through IVF should not be treated as property, but as human beings:
A review of
the current relevant science establishes that the embryos are human
beings at fertilization and may not be treated, as some courts have
done, as property, or as less than fully human, and without rights to
parental or governmental protection.
Legal documents in the case allege that
Vergara frequently abused Loeb and coerced him to sign documents
regarding the children that he did not wish to sign. Again, the Daily
Mail reports:
Court documents alleged Sofia bullied Nick but told her ex-fiance she had started IVF for him to become a father.
The legal
papers claims the 43-year-old actress told Nick she was pro-life and
that she promised each embryo created would ultimately be implanted into
a surrogate.
However, the
Colombian actress, who recently married actor Joe Manganiello, claims
that her former flame is just trying to take advantage of her career by
publicly fighting to take the embryos to full term.
The use of IVF and surrogacy are
controversial for several reasons, one of which was mentioned by the
Thomas More Society: in the fertility industry, children conceived
through artificial means are often treated as commodities and as
disposable property instead of as human beings with rights.
Besides the two daughters conceived through IVF, Vergara has an adult son from a previous marriage.
The past few years have seen a record number of
pro-life state laws passed, including tougher regulations on abortion
clinics. Other laws recently passed also include waiting periods and
restrictions on when and how abortion can take place. More than 50 such
laws were passed across the nation in 2015 alone, and it appears the
trend may continue in 2016.
After New Year’s Day, state legislatures will soon begin spring
sessions, many of which will see abortion related measures introduced.
For example, Missouri State Senator David Sater is introducing a bill
that would ban abortions sought due solely to the baby having Down
syndrome. Sater told reporters he believes babies with Down syndrome
“deserve life and shouldn’t be discriminated against.” “Most grow up to
be fine citizens and they’re loved and I think it’s inhumane to abort
someone just because they’re a little different,” he explained.
North Dakota is the only state to currently have a law banning
abortions sought due to genetic abnormalities, including Down syndrome.
A bill pending in Ohio would introduce new regulations on the
disposal of fetal tissue following abortions. The proposed measure
follows an investigation
which found some Planned Parenthood clinics in the state were
improperly disposing of fetal remains in landfills. The legislators
behind the measure say they want to ensure that fetal remains are
treated in a respectful way.
As pro-life legislation continues to increase, 2016 could prove to be a succesful year for the pro-life movement.
David Boonin is a pro-choice philosophy professor who wrote the book A Defense of Abortion. The book is dedicated to supporting and promoting legalized abortion. However, there is something very telling in its introduction. Boonin says:
In the top drawer of my desk, I keep [a
picture of my son]. This picture was taken on September 7, 1993, 24
weeks before he was born. The sonogram image is murky, but it reveals
clear enough a small head tilted back slightly, and an arm raised up and
bent, with the hand pointing back toward the face and the thumb
extended out toward the mouth. There is no doubt in my mind that this
picture, too, shows [my son] at a very early stage in his physical
development. And there is no question that the position I defend in this
book entails that it would have been morally permissible to end his
life at this point.
Such honesty from a pro-choice activist is rare. (Although not
unheard of – I wrote an article containing quotes from pro-choice
leaders and activists admitting the baby in the womb is a human life here.)
It is remarkable that Boonin could write an entire book defending
something that he concedes could’ve taken the life of his own child.
Somehow, the ultrasound picture of his own baby doesn’t sway him.
Instead, he defends putting to death babies at the same age as his child
in the picture. He shows a shocking disregard for life as he accepts
that someone could have chosen to end the life of his son- and he is
perfectly ok with that.
Pro-lifers often find abortion supporters who admit abortion takes a
life hard to understand and debate with. How do you address abortion’s
legality when a person acknowledges that abortion is killing but just
doesn’t care? This level of cold heartedness seems overwhelming. What a
pro-choice person concedes pro-life points about the beginning of life
but still advocates killing, it can be hard to know what to say next.
Often, changing the person’s heart is beyond the capabilities of a
pro-lifer. It is hard to manufacture compassion in the hardened heart of
another person.
Boonin’s position clearly shows the moral bankruptcy of the
pro-choice stand. The belief that life is expendable and can be
destroyed for another person’s convenience is the crux of the pro-choice
position, whether pro-choice activists admit it or not. Like nothing
else, reading this kind of admission helps pro-lifers realize we are
truly standing against an evil ideology.
But pro-life writer Dave Andrusko of National Right to Life does a good job at deconstructing the poll further.
He also notes how the AP survey reinforces the point that popular
support for the Planned Parenthood abortion business is down
significantly compared to its high water mark of 82% back in 1982. He is
right that America now has a much more negative view of the abortion
business now that they know it’s America’s biggest abortion company and
that it sells the body parts of aborted babies.
#4. The AP-GfK survey also asked Do you have a favorable or unfavorable impression of Planned
Parenthood? If you don’t know enough about Planned Parenthood to have an
opinion, you can say that too.
45%-30%-24%. What can we say about this? (The wording is slightly different in the following polls.)
When Gallup polled in 1989, 82% of Americans had a favorable
impression of Planned Parenthood. In a February 2012 Quinnipiac
University poll, 55% had a favorable opinion of PPFA, 22% an unfavorable
opinion.
But a July 30-August 2, 2015, Monmouth University poll found 37% had a favorable view of PPFA and 26% an unfavorable view. A CBS News/New York Times September 2015 poll found 40% of Americans had a favorable opinion of PPFA and 27% an unfavorable opinion of PPFA.
So the numbers for PPFA have dropped enormously, not just since 1989
but since February 2012. For the moment, they have stabilized, in no
small part, I would guess, because of the countless news stories,
columns, and editorials painting the $1.3 billion “non-profit” as a
victim.
My guess is the numbers will begin their decline again in the not-too-distant future. PPFA carries way too much baggage.
Planned Parenthood has dropped a long way from 82 percent to 45
percent. And with one-quarter of Americans saying they don’t have enough
information to know if they think of the abortion giant favorably or
not the pro-life movement must continue educating Americans. With that,
here’s the list of expose’ videos catching Planned Parenthood officials
selling the body parts of aborted babies have shocked the nation. Here
is a list of all eleven:
In the first video:
Dr. Deborah Nucatola of Planned Parenthood commented on baby-crushing:
“We’ve been very good at getting heart, lung, liver, because we know
that, so I’m not gonna crush that part, I’m gonna basically crush below,
I’m gonna crush above, and I’m gonna see if I can get it all intact.”
In the second video: Planned Parenthood’s Dr. Mary Gatter joked, “I want a Lamborghini” as she negotiated the best price for baby parts.
In the third video:
Holly O’Donnell, a former Stem Express employee who worked inside a
Planned Parenthood clinic, detailed first-hand the unspeakable
atrocities and how she fainted in horror over handling baby legs.
In the fourth video:
Planned Parenthood’s Dr. Savita Ginde stated, “We don’t want to do just
a flat-fee (per baby) of like, $200. A per-item thing works a little
better, just because we can see how much we can get out of it.” She also
laughed while looking at a plate of fetal kidneys that were “good to
go.”
In the fifth video:
Melissa Farrell of Planned Parenthood-Gulf Coast in Houston boasted of
Planned Parenthood’s skill in obtaining “intact fetal cadavers” and how
her “research” department “contributes so much to the bottom line of our
organization here, you know we’re one of the largest affiliates, our
Research Department is the largest in the United States.”
In the sixth video: Holly
O’Donnell described technicians taking fetal parts without patient
consent: “There were times when they would just take what they wanted.
And these mothers don’t know. And there’s no way they would know.”
In the seventh and perhaps most disturbing video:
Holly O’Donnell described the harvesting, or “procurement,” of organs
from a nearly intact late-term fetus aborted at Planned Parenthood Mar
Monte’s Alameda clinic in San Jose, CA. “‘You want to see something kind
of cool,’” O’Donnell says her supervisor asked her. “And she just taps
the heart, and it starts beating. And I’m sitting here and I’m looking
at this fetus, and its heart is beating, and I don’t know what to
think.”
In the eighth video: StemExpress CEO Cate Dyer admits Planned Parenthood sells “a lot of” fully intact aborted babies.
The ninth video:
catches a Planned Parenthood medical director discussing how the
abortion company sells fully intact aborted babies — including one who
“just fell out” of the womb.
The 10th video:
catches the nation’s biggest abortion business selling specific body
parts — including the heart, eyes and “gonads” of unborn babies. The
video also shows the shocking ways in which Planned Parenthood officials
admit that they are breaking federal law by selling aborted baby body
parts for profit.
Unreleased Videos:
Unreleased videos from CMP show Deb Vanderhei of Planned Parenthood
caught on tape talking about how Planned Parenthood abortion business
affiliates may “want to increase revenue [from selling baby parts] but
we can’t stop them…” Another video has a woman talking about the
“financial incentives” of selling aborted baby body parts.
The 11th video:
catches a texas Planned Parenthood abortionist planning to sell the
intact heads of aborted babies for research. Amna Dermish is caught on
tape describing an illegal partial-birth abortion procedure to terminate
living, late-term unborn babies which she hopes will yield intact fetal
heads for brain harvesting.
Here’s One Thing Hillary Clinton is Guaranteed to Do to Keep Abortion Legal for Decades if Elected
Micaiah Bilger
The
next U.S. president will have a hugely influential task handed to them
that could affect the rights of unborn babies for decades – that of
appointing judges to the U.S. Supreme Court.
Up to four of the nine seats on the high court could come open within
the next president’s term, meaning that the next president’s appointees
could sway the court’s decisions for decades.
That’s a power that pro-abortion Democratic candidate Hillary Clinton would like to get her hands on.
Clinton’s campaign website
published a piece earlier this month warning supporters of the
“terrifying” effects these decisions could have in the hands of the
wrong president.
Indeed, it would be “terrifying” for unborn babies if Clinton is
elected president. Her radical abortion policies passed onto through
appointments to the U.S. Supreme Court could mean huge setbacks for the
rights of unborn babies in America.
Clinton supports complete, unrestricted abortion through all nine
months of pregnancy, and the abortion industry believes she will work to expand abortion if elected. Clinton’s extreme abortion stance is out of touch with most Americans.
In a Sept. 20 interview with CBS’ Face the Nation moderator John Dickerson, Hillary Clinton revealed that she wouldn’t support a federal limit on abortion “at any state of pregnancy” in the name of a “woman’s right to choose.”
If Clinton were allowed to impose these extreme positions through
appointees to the U.S. Supreme Court, many of the pro-life advancements
passed in recent years could be put in jeopardy – including late-term
and partial-birth abortion bans, informed consent laws, sex-based
abortion bans, abortion facility regulations and more.
However, with a pro-life president, there is hope of protections
being restored for unborn babies – something that Clinton’s campaign
acknowledged.
“Justice [Antonin] Scalia has long called for overturning Roe …
Just one more conservative justice on the bench, and he could get his
wish,” according to Clinton’s website. “And many—including Carly
Fiorina, Marco Rubio, and Ben Carson—would overturn Roe to make that happen.”
Rubio recently called Roe v. Wade “constitutionally flawed,” while Carson took flak
for saying he wants the radical abortion ruling to be overturned. Other
Republican presidential candidates have made similar remarks against
the ruling that’s responsible for more than 57 million unborn babies’
deaths.
Currently, the U.S. Supreme Court is split between liberal and
conservative justices. Justice Anthony Kennedy is a moderate whose
opinions often sway the court in one direction or the other.
A major abortion case currently is before the high court. In
November, the court agreed to consider a pro-life Texas law responsible
for closing abortion clinics, LifeNews previously reported.
The legislation, House Bill 2 (HB2), requires abortion facilities to
meet the same safety standards of other Ambulatory Surgical Centers in
the state, ensures that abortionists have admitting privileges at a
local hospital, and bans painful late abortions on fully formed babies.
Mixed news came Tuesday regarding Planned Parenthood and the group’s fetal parts trafficking practices.
As the Hill reports, the
Department of Health and Human Services Office of Inspector General
(IG) announced that there will be an investigation of federal oversight
on fetal tissue research. However, HHS will not investigate Planned
Parenthood — even after a dozen videos released this summer show
top-level Planned Parenthood executives discussing the harvesting
of baby body parts.
The announcement came after a written request in October from 35 Republican senators, including presidential hopeful Rand Paul.
The Inspector General says it will probe the National Institute of
Health’s grants for fetal tissue research, as well as research conducted
by the NIH. The IG also plans to investigate federal oversight
regarding the practice.
The letter to Paul stated:
…we will interview HHS and National
Institutes of Health (NIH) officials, as the majority of HHS funding for
human fetal tissue research is awarded through NIH. This approach will
also focus on gathering relevant documentation related to policies and
procedures for monitoring fetal tissue research activities. Our goal is
to obtain information related to fetal tissue research grants, NIH’s
monitoring procedures over third-party certifications and those related
to the Department’s internal fetal research, and any known violations of
Federal requirements.
Planned Parenthood has applauded the investigation. Such a move is
not shocking, however, considering the Obama administration’s longtime
support for Planned Parenthood. However, with the small steps that are
being taken, there can be hope for an honest investigation.
